The State establishes the minimum and maximum amount of child maintenance. This amount of alimony is determined and based on the living wage for children of the different age cohorts. Since the living wage was reviewed in 2019, the amount of child maintenance has also been changed.
Minimum child maintenance
The minimum guaranteed amount of alimony is 50% of the living wage for children of the different age groups. In 2019 these amounts will be as follows:
- for children under 6 years old – 849.5 UAH. (from July 1, 2019); 889.5 UAH. (from December 1, 2019).
- for children from 6 to 18 years old – 1 059 UAH. (from July 1, 2019); 1 109 UAH. (from December 1, 2019).
The minimum recommended amount of alimony is set at 100% of the living wage for children of the different age cohorts:
- for children under 6 years old – 1 699 UAH. (from July 1, 2019); 1 779 UAH. (from December 1, 2019).
- for children from 6 to 18 years old – 2 118 UAH. (from July 1, 2019); 2 218 UAH. (from December 1, 2019).
We remind you that it is possible to get the minimum guaranteed amount of child maintenance according to the writ (summary) proceedings. For this, you have to apply for alimony writ at the place of residence of maintenance payer or where the person who collects payments and lives with the child is registered.
Unlike the guaranteed, the minimum recommended amount of child maintenance can be established by the court in the ordinary civil suits.
Maximum child maintenance
In the case when maintenance payer pays alimony as a part of income, the maximum amount of maintenance is 10 living wage for children of the different age cohorts. So far the maximum sizes of alimony are:
- for children under 6 years old – 16 990 UAH. (from July 1, 2019); 17 790 UAH. (from December1, 2019).
- for children from 6 to 18 years old – 21 180 UAH. (from July 1, 2019); 22 180 UAH. (from December 1, 2019).
Another type of maintenance recovery is the form of a fixed sum. It this case there is no maximum amount of child maintenance.
In addition, to recover more than the minimum amount of alimony, it is necessary to justify and prove the following circumstances. The needs for such an amount of alimony must be determined by the health status of the child, the financial conditions of alimony payer etc.
