GENERAL MOBILIZATION. WHO IS NOT SUBJECT TO CONSCRIPTION

On February 24, 2022, a full-scale invasion of the Russian Federation into the territory of Ukraine began. On the same day, the president issued Decree No. 69/2022 “On General Mobilization”, announcing the general mobilization. By Decree of the President of Ukraine No. 574 dated August 12, 2022, the period of general mobilization was extended from August 23, 2022 for 90 days.

General mobilization is the replenishment of the Armed Forces of Ukraine with new servicemen throughout the country.

In accordance with the Law of Ukraine “On Mobilization Training and Mobilization”, general mobilization is carried out simultaneously throughout the territory of Ukraine and concerns the national economy, state authorities, other state bodies, local self-government bodies, the Armed Forces of Ukraine, other military formations, the Civilian Emergency Rescue Service protection, enterprises, institutions and organizations.

All citizens of Ukraine between the ages of 18 and 60 who are able to perform their military duty are subject to mobilization, except for exceptions provided by law.

GROUNDS FOR EXEMPTION FROM MOBILIZATION

The list of grounds for exemption (granting a postponement) from mobilization is defined by Article 23 of the Law of Ukraine “On Mobilization Training and Mobilization”.

Yes, conscripts are not subject to conscription for military service during mobilization:

  • reserved for the period of mobilization and wartime by state authorities, other state bodies, local self-government bodies, as well as by enterprises, institutions and organizations;
  • recognized in the established procedure as persons with disabilities or, according to the opinion of the VLK, temporarily unfit for military service due to their health for a period of up to six months;
  • women and men who are dependent on 3 or more children under the age of 18;
  • women and men who independently raise a child (children) under the age of 18;
  • women and men, guardians, custodians, adoptive parents, foster parents who raise a child with a disability under the age of 18;
  • women and men, guardians, custodians, adoptive parents, foster parents raising a child with severe perinatal damage to the nervous system, severe congenital malformations, rare orphan diseases, oncological, oncohematological diseases, cerebral palsy, severe mental disorders, diabetes type I diabetes (insulin-dependent), acute or chronic kidney diseases of the IV degree, etc.;
  • women and men who are dependent on an adult child who is a person with a disability of group I or II;
  • adoptive parents, guardians, custodians, adoptive parents, foster parents who are dependent on orphans or children deprived of parental care under the age of 18;
  • engaged in constant care for a sick wife (husband), child, as well as their own parents or wife (husband), who, according to the conclusion of the MSEK or LKK of the health care institution, need constant care;
  • who have a wife (husband) from among persons with disabilities and/or one of their parents or parents of a wife (husband) from among persons with disabilities of group I or II;
  • guardians of a person with a disability recognized by the court as incapable; persons engaged in permanent care of a person with a disability of group I; persons engaged in constant care for a person with a disability of group II or for a person who, according to the opinion of the MSEK or LCC of a health care institution, needs constant care, in the absence of other persons who can provide such care;
  • women and men who have a minor child(ren) and a husband (wife) who is in military service under one of the types of military service defined by part six of Article 2 of the Law of Ukraine “On Military Duty and Military Service”;
  • employees of military management bodies (management bodies), military units (units), enterprises, institutions and organizations of the Ministry of Defense of Ukraine, the Armed Forces of Ukraine, the State Service for Special Communications and Information Protection of Ukraine, the Security Service of Ukraine, the Foreign Intelligence Service of Ukraine, the National Guard of Ukraine, the State Border Service of Ukraine, the National Police of Ukraine, the tax police, the National Anti-Corruption Bureau of Ukraine, the State Bureau of Investigation, the State Executive Service of Ukraine, the State Security Office of Ukraine;
  • other conscripts or certain categories of citizens in cases provided for by law.

The following are also not subject to conscription for military service during mobilization, for a special period:

  • students of professional (vocational and technical), professional pre-higher and higher education, trainee assistants, graduate students and doctoral students studying full-time or dual forms of education;
  • scientific and scientific-pedagogical employees of institutions of higher and vocational pre-university education, scientific institutions and organizations who have an academic title and/or scientific degree, and pedagogical employees of professional (vocational-technical) education institutions, general secondary education institutions, provided that they work respectively, in institutions of higher or professional higher education, scientific institutions and organizations, institutions of professional (vocational and technical) or general secondary education according to the main place of work by at least 0.75 rates;
  • women and men whose close relatives (husband, wife, son, daughter, father, mother, grandfather, grandmother or biological (consanguineous, non-consanguineous) brother or sister) died or went missing during the ATO;
  • women and men whose close relatives (husband, wife, son, daughter, father, mother, grandfather, grandmother or biological (consanguineous, non-consanguineous) brother or sister) died or went missing during the implementation of measures to ensure national security and defense, resistance and deterring the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, as well as during the provision of national security and defense, repelling and deterring armed aggression against Ukraine during martial law.
