Supreme Court of Ukraine expressed its legal position on the issue of recovering insurance payments. This case concerned a claim of the insurance company to the person responsible for causing the accident with the demand to compensate amount of insurance payments.
The Supreme Court decided that the insurance company paying insurance payments receives a right to demand the compensation in amount of the difference between the damage and the insurance paymentі to the person responsible for the damage.
This means that if you are guilty in an accident and your insurance company pays only part of the damage, the victim’s insurance company can sue you to compensate another part of insurance payments.
